1. Acceptance of Terms
By accessing and using SiteNudge ("the Service"), provided by Ashfield Trading Limited (Company Number: 16358723), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service
SiteNudge is a WhatsApp receptionist service designed to help UK tradespeople capture and manage leads while they're working on-site. The service includes:
- WhatsApp Business integration and setup
- Automated responses to customer inquiries
- Lead qualification and information capture
- Lead organization and status tracking
- Conversation history and transcript storage
- Done-for-you setup and ongoing management
We handle the setup, customization, and management of your WhatsApp receptionist so you can focus on your work.
3. User Accounts
To use our Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account and password
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized use
4. Payment Terms
Our Service operates on a simple subscription model:
- Setup Fee: £150 one-time payment (normally £300, currently 50% off for early users)
- Monthly Subscription: £50 per month
- No Contracts: Cancel anytime with no penalty
- No Hidden Fees: No per-message charges or usage limits
All payments are processed securely through Stripe. You will be billed monthly on the anniversary of your sign-up date.
Cancellation and Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- The setup fee is non-refundable after service has been activated
- Monthly fees are not refunded for partial months
- You will retain access to your leads and data upon cancellation
5. Data and Privacy
We are committed to protecting your data:
- All data is encrypted in transit and at rest
- We do not sell or share your personal data with third parties
- You retain full ownership of your business data
- You can export your data at any time
- We comply with GDPR and UK data protection regulations

6. Acceptable Use
You agree not to use the Service to:
- Violate any laws or regulations
- Send spam or unsolicited mass communications
- Harass, abuse, or threaten customers or other users
- Attempt to gain unauthorized access to our systems
- Use the Service for any illegal or unauthorized purpose
- Interfere with or disrupt the Service
- Violate WhatsApp's Terms of Service or Business Policies
We reserve the right to suspend or terminate accounts that violate these acceptable use policies.
7. Service Availability
We strive to maintain high service availability but cannot guarantee 100% uptime. We will:
- Provide reasonable notice for scheduled maintenance
- Work to resolve outages as quickly as possible
- Not be liable for service interruptions beyond our control
8. Termination
Either party may terminate this agreement at any time:
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- We may suspend or terminate accounts that violate these terms
- Upon termination, you retain the right to export your lead data
- We will retain your data for 30 days after termination for recovery purposes
- After 30 days, all data will be permanently deleted
9. Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for loss of profits, data, or business opportunities
10. Changes to Terms
We may update these terms from time to time. We will:
- Notify you of significant changes via email
- Post the updated terms on our website
- Allow you to review and accept the new terms
- Continue to honor your existing terms if you do not accept the changes
